these terms of use ("terms") govern your use of the tanmaxx ios app and related services (the "service"). by downloading, installing, or using tanmaxx, you agree to these terms. if you do not agree, do not use the service.
apple end user license agreement
your use of tanmaxx is also governed by apple's standard licensed application end user license agreement ("apple eula"). to the extent these terms conflict with the apple eula, the apple eula controls with respect to your license to use the app obtained through the app store.

description of the service
tanmaxx is an ios app that turns live uv data into personal tanning guidance. features may include hour-by-hour uv forecasts for your location, session plans with timed sun and spf breaks, a smart session timer measured in kiu (tanmaxx's sun dose unit), ai skin scans that estimate tan and skin wellness metrics, an ai tanning coach chat, daily plans, streaks, and a progress calendar.
tanmaxx does not require an account or login. the app stores your data locally on your device. we operate no user database and do not receive, store, retain, or sell your photos, face data, scores, or results on our systems. when you use ai features, your photo or message is processed transiently by a third party ai provider (openai), and subscription status is verified through apple and revenuecat, as described in our privacy policy.
eligibility
you must be at least 13 years old to use tanmaxx. if you are under the age of majority in your jurisdiction, you may use the service only with permission from a parent or legal guardian.
subscriptions and billing (tanmaxx premium)
certain features require tanmaxx premium, an auto-renewable subscription offered in the app store.
- plans: weekly and yearly subscriptions. the yearly plan includes a 3-day free trial.
- pricing: current prices and trial terms are displayed in the app before you subscribe.
- billing: all purchases and renewals are processed by apple through your apple id. we do not collect or store payment card or billing information.
- auto-renewal: subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period.
- free trial: if you start a free trial, you will be charged when the trial ends unless you cancel at least 24 hours before renewal.
- promotional offers: we may occasionally make discounted or win-back offers available through the app store; their terms are shown before you accept.
- management: view, change, or cancel subscriptions in ios settings → apple id → subscriptions.
- refunds: handled by apple, typically through reportaproblem.apple.com.
acceptable use
you agree to use tanmaxx lawfully and responsibly. you must not:
- violate any applicable law or third party rights;
- upload, generate, or share illegal, abusive, harassing, or non-consensual content;
- use the service to impersonate others or harm, defame, or harass anyone;
- attempt to reverse engineer, scrape, disrupt, or interfere with the app's security or functionality;
- misrepresent ai estimates, scores, or plans as professional, medical, or clinical assessments.
you are responsible for ensuring you have the right to use any photo you submit, including photos of other people, and that your use complies with applicable law.
photos, ai outputs, and privacy
when you choose to scan, tanmaxx accesses your camera only to capture a selfie for that scan. scan results are generated using openai (gpt-4o-mini). coach chat replies are also generated using openai (text only, photos are never attached to chat messages). openai processes your content only to return a result.
tanmaxx stores no user data on its own servers. photos, scans, sessions, plans, streaks, and other app data remain on your device until you delete them. we do not sell your personal information. full details are in our privacy policy, including the dedicated face data and photos section.
ai scores, estimates, plans, and chat replies are automated outputs. they may be imperfect or subjective. you retain rights in photos you submit. you grant tanmaxx and its ai providers a limited, temporary license to process your submitted photo solely to operate the feature you request.
sun safety, not medical advice
tanmaxx is a wellness, planning, and entertainment tool. uv forecasts, kiu values, session plans, break schedules, timers, ai skin scores, and coach replies are estimates and general guidance. they are not medical, dermatological, or professional advice, and they are not clinical assessments, diagnoses, or treatment recommendations.
sun exposure carries real risks, including sunburn, premature skin aging, skin cancer, heat illness, eye injury, allergic or photosensitive reactions, and other personal injury. no app can make uv exposure risk free. you are solely responsible for your own sun exposure decisions, including how long you stay in the sun, whether you use sunscreen or protective clothing, and whether tanning is appropriate for your health. know your skin, use sunscreen, avoid burning, and stop immediately if your skin shows signs of redness, irritation, pain, dizziness, or other concerning symptoms.
tanmaxx's guidance is intentionally conservative, but conditions vary and readings can be delayed, incomplete, unavailable, or wrong. you should not rely on tanmaxx as your only safety measure. consult a qualified medical professional about moles, skin changes, photosensitive conditions, medications that increase sun sensitivity, a history of skin cancer, pregnancy, or any other health concerns before tanning.
intellectual property
the service, including software, branding, interface design, and content we provide (excluding your photos and user generated content), is owned by tanmaxx or its licensors and protected by intellectual property laws. these terms do not grant you any rights to our trademarks or branding except as needed to use the service.
disclaimers
the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
we do not guarantee uninterrupted access, error-free operation, the accuracy of uv data supplied by third parties, or that ai outputs will meet your expectations. features may change, be suspended, or be discontinued at any time.
limitation of liability
to the maximum extent permitted by applicable law, tanmaxx and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the service, including any harm related to sun exposure decisions made using the app's guidance.
to the maximum extent permitted by applicable law, you agree that tanmaxx and its operators are not responsible for sunburn, skin cancer, heat illness, eye injury, allergic reactions, photosensitive reactions, burns, illness, injury, death, or other harm that may result from tanning, uv exposure, outdoor activity, misuse of the app, inaccurate third party data, ai output, timer issues, notification failures, or your decision to follow or disregard app guidance.
to the maximum extent permitted by law, our total liability for any claim arising from these terms or the service will not exceed the greater of (a) the amount you paid for tanmaxx premium in the 12 months before the claim, or (b) usd $50.
some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
suspension and termination
you may stop using tanmaxx at any time by uninstalling the app. we may suspend or discontinue the service, or restrict access, if you violate these terms or if required for legal, security, or operational reasons.
changes to these terms
we may update these terms from time to time. material changes will be reflected by the "last updated" date above and may also be presented in the app. continued use after an update means you accept the revised terms.
